A new “chapter 11 type” law entered into force on January 1, 2021. The Act on Court confirmation of extrajudicial restructuring plans (CERP) provides that the court can approve a private agreement between a company and its creditors and shareholders on the restructuring of its debts, also called homologation.
Powerful restructuring tool
The CERP gives companies the opportunity to make new agreements about the scope and conditions of claims. These agreements may include cancellation of the debts, whereby reluctant creditors can be forced to cooperate.
We help you use the CERP
As restructuring specialists, the CERP gives us an additional tool to help you when your business is in dire straits. Reorganizing and restructuring debt helps your business survive and secure its existence.
New money will always be needed in a CERP process. That new money can be made available partly as debt and partly as risk bearing capital. There will be little time to arrange such new money. Crescera can complete this process for stressed companies in an accelerated procedure.
